1. General Provisions

These Terms and Conditions ("Terms") govern the use of the website cosmall.eu (the "Website") and all purchases made through it. By placing an order on the Website, you ("Customer", "you") accept these Terms in full. These Terms apply to consumers and businesses within the European Union and European Economic Area, in accordance with applicable EU consumer protection law, including Directive 2011/83/EU on consumer rights.

2. Seller Identification

(referred to below as "we", "us", "the Seller")

2a. Change of Operating Entity

Until 30 June 2026, the Website was operated by Medloft Beauty LTD, a company registered in Cyprus:

As of 1 July 2026, the Website and all new orders are operated by SIA VV Invest (Latvia), as identified in Section 2 above.

• For orders placed before 1 July 2026, all matters relating to that order — including delivery, returns, withdrawal, warranty claims, and complaints — remain the responsibility of Medloft Beauty LTD and are handled under the terms in force at the time the order was placed.
• For orders placed on or after 1 July 2026, all matters relating to that order are the responsibility of SIA VV Invest under these Terms.
• Customers may direct enquiries about any order to support@cosmall.eu; enquiries will be routed to the entity responsible for that order based on the order date.

3. Products and Prices

• All product descriptions, images, and prices on the Website are provided for informational purposes and may be updated without prior notice.
• Prices are displayed in EUR and include statutory VAT unless stated otherwise. Delivery costs, if any, are shown separately before order confirmation.
• We reserve the right to correct pricing or listing errors. If an item was ordered at an incorrect price, we will contact you before processing the order.
• Product availability is not guaranteed until order confirmation is issued.

4. Placing an Order

• An order is placed by adding products to the cart, completing the checkout form, and confirming payment.
• A contract of sale is formed once we send an order confirmation email to the address provided by the Customer.
• You are responsible for ensuring that the information provided at checkout (name, delivery address, contact details) is accurate.
• We reserve the right to refuse or cancel an order in cases of suspected fraud, pricing errors, or unavailability of stock, with a full refund provided where payment has already been made.

5. Payment

• Accepted payment methods are displayed at checkout [e.g. credit/debit card, bank transfer].
• Card and online payments are processed by our payment service provider, Viva Payments S.A. ("Viva.com"), an electronic money institution authorised and supervised by the Bank of Greece under the EU Payment Services Directive (PSD2), passported to provide payment services across the EU/EEA. Viva.com processes payment data on our behalf under PCI DSS-compliant infrastructure; we do not receive or store full card details, which are handled directly by Viva.com's secure payment gateway.
• By completing a payment, the Customer also agrees to Viva.com's applicable payment terms and privacy practices, available at viva.com. We are not responsible for the operation of Viva.com's payment infrastructure, but remain fully responsible for the underlying sales contract with the Customer.
• Any payment disputes, failed transactions, or chargeback queries relating to the payment method itself should be reported to us at support@cosmall.eu; order-related complaints (product, delivery, returns) are handled directly by us as the Seller, not by Viva.com.
• All orders must be paid in full before dispatch, unless otherwise agreed.

6. Delivery

• We deliver to the countries listed at checkout [list of EU/other countries served].
• Shipments are arranged through Swotzy, a multi-carrier shipping platform that aggregates postal and courier services (e.g. DPD, Omniva, Express Pasts, and other integrated carriers) and enables us to book and manage deliveries. The actual collection, transport, sorting, and delivery of each shipment is carried out by the postal/courier operator selected via Swotzy for that order, not by Swotzy itself.
• Estimated delivery times shown at checkout are provided by the relevant carrier via Swotzy and are approximate, not binding, unless expressly stated as a fixed deadline.
• Unless otherwise agreed, goods will be delivered without undue delay and no later than 30 days from the conclusion of the contract, in line with EU consumer protection standards.
• Risk of loss or damage to goods passes to the Customer upon delivery to the address provided, or to the carrier if the Customer arranged their own delivery service.
• If a carrier is unable to deliver a shipment and it is returned to us, any resulting return-delivery costs may be charged to the Customer, except where the failed delivery was due to our error or a fault of the carrier.
• If delivery is delayed beyond the agreed period, the Customer may request delivery within an additional reasonable period; if this is not met, the Customer may terminate the contract and receive a full refund. We remain responsible to the Customer for successful delivery regardless of which carrier is used via Swotzy.

7. Right of Withdrawal (14-Day Cooling-Off Period)

In accordance with Directive 2011/83/EU, consumers residing in the EU have the right to withdraw from a purchase without giving any reason within 14 calendar days.

• The withdrawal period expires 14 days from the day the Customer (or a third party named by the Customer) takes physical possession of the goods.
• To exercise this right, the Customer must inform us of the decision to withdraw via a clear statement sent to support@cosmall.eu before the deadline expires.
• The Customer must return the goods without undue delay and within 14 days of communicating the withdrawal, in their original condition where reasonably possible.
• Return shipping costs are borne by the Customer, unless the goods were faulty or incorrectly described.
• We will reimburse all payments received, including standard delivery costs, within 14 days of receiving the returned goods or proof of dispatch, using the same payment method used for the original transaction.
• The right of withdrawal does not apply to: sealed goods unsealed after delivery which are not suitable for return for health or hygiene reasons; personalized or custom-made products; digital content supplied on a durable medium once unsealed; and other exemptions listed in Article 16 of Directive 2011/83/EU.

8. Legal Guarantee of Conformity (Warranty)

• All goods sold benefit from the statutory legal guarantee of conformity applicable in the EU, generally 2 years from delivery, during which we are liable for any lack of conformity that exists at the time of delivery.
• If a product is faulty or not as described, the Customer is entitled to a repair, replacement, price reduction, or contract termination, in accordance with applicable national law implementing Directive (EU) 2019/771.
• To make a claim, the Customer should contact support@cosmall.eu with proof of purchase and a description of the defect.
• This legal guarantee is separate from, and unaffected by, any additional commercial warranty that may be offered on specific products.

9. Complaints and Dispute Resolution

• Complaints regarding orders, deliveries, or products can be submitted to support@cosmall.eu. We will acknowledge and respond to written complaints within 14 days of receipt, in line with the response deadline set out in Latvian consumer protection legislation (Patērētāju tiesību aizsardzības likums).
• EU consumers may also submit disputes via the European Commission's Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr
• Consumers may also contact their national consumer protection authority or an alternative dispute resolution (ADR) body where available.

10. Liability

• To the extent permitted by applicable law, our liability is limited to direct damages caused by intentional misconduct or gross negligence.
• We are not liable for indirect, incidental, or consequential damages arising from the use of the Website or products, except where such liability cannot be excluded under mandatory consumer protection law.
• Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

11. Intellectual Property

All content on the Website — including text, images, logos, and design — is the property of SIA VV Invest or its licensors and is protected by applicable intellectual property laws. Reproduction or use without prior written consent is prohibited.

12. Personal Data

Personal data provided during the ordering process is processed in accordance with our [Privacy Policy] and applicable data protection law, including the General Data Protection Regulation (GDPR).

13. Force Majeure

We are not liable for delays or failure to perform obligations under these Terms where such delay or failure results from circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, transport disruptions, or acts of government.

14. Amendments to these Terms

We may update these Terms from time to time to reflect changes in our practices or legal requirements. The version in force at the time an order is placed will apply to that order. The current version is always available on this page.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Latvia, without prejudice to any mandatory consumer protection provisions of the country in which the Customer is habitually resident. Consumers may bring proceedings in the courts of their country of residence or the courts of Latvia, as applicable under EU law.
